Welcome to the beta testing program ("Beta Program") for the matrimony platform ("Service") operated by Aham Digital, a service operated by Babu Ventures LLC, a North Carolina limited liability company ("Aham Digital", "Company", "we", "us", or "our"). By accessing or using the Service during the beta period, you ("Tester", "you", or "your") agree to be bound by this Beta Testing Agreement ("Agreement"). If you do not agree, you must immediately stop using the Service.
The Service is in a pre-release beta stage. It is under active development and may contain bugs, errors, incomplete features, or performance issues. Features may be added, changed, or removed at any time without prior notice. The beta is intended for testing and evaluation purposes only and should not be relied upon for critical or time-sensitive matchmaking decisions.
THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.
During the beta period, your data — including but not limited to profile information, messages, photos, preferences, and activity history — may be lost, corrupted, or reset at any time due to system updates, migrations, bug fixes, or infrastructure changes. You are solely responsible for maintaining backup copies of any content you submit. We are not liable for any data loss during the beta period.
All payment and subscription features are disabled during the beta period. The Service is provided free of charge to beta testers. No financial transactions will be processed. Premium features may be made available for testing purposes at no cost. When the Service transitions out of beta, separate terms and pricing will apply.
By providing any feedback, suggestions, bug reports, feature requests, or other communications regarding the Service ("Feedback"), you grant Aham Digital a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display such Feedback for any purpose, including improving the Service and creating derivative works, without any obligation of compensation or attribution to you.
You acknowledge that the Service, its features, design, and performance characteristics during the beta period constitute confidential information of Aham Digital. You agree not to disclose, publish, or disseminate confidential information about unreleased features or internal workings of the Service to any third party without our prior written consent. General discussion of publicly visible features is permitted.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AHAM DIGITAL, BABU VENTURES LLC, THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100).
We may modify, suspend, or terminate the Service or your access to it at any time, for any reason, without prior notice or liability. You may stop using the Service at any time. Upon termination, your right to access the Service ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law shall survive termination.
You must be at least 18 years of age to participate in the Beta Program. By accepting this Agreement, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement. If you are accessing the Service from a jurisdiction where use of the Service is prohibited, you do so at your own risk.
You agree to indemnify, defend, and hold harmless Aham Digital, Babu Ventures LLC, and their affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of this Agreement, or your violation of any rights of another party.
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be resolved exclusively in the state or federal courts located in Wake County, North Carolina.
We reserve the right to modify this Agreement at any time. If we make material changes, we will notify you through the Service (for example, by requiring re-acknowledgment). Your continued use of the Service after such changes constitutes your acceptance of the revised Agreement. It is your responsibility to review this Agreement periodically.
This Agreement, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Aham Digital regarding the Beta Program and supersedes all prior or contemporaneous communications, proposals, and agreements, whether oral or written, relating to the subject matter herein.
